2. Purposes of processing
We process your personal data in accordance with the provisions of the General Data Protection Regulation (GDPR), the German Federal Data Protection Act (BDSG) and other applicable data protection regulations for the following purposes

3. Legal basis
The processing of your data for the implementation of the Fritz Berger advantage card bonus programme is permissible because this is necessary for the implementation of the contractual relationship with you for participation in the Fritz Berger advantage card bonus programme (Art. 6 para. 1 sentence 1 lit. b) GDPR) and because we have an overriding legitimate interest (Art. 6 para. 1 sentence 1 lit. f) GDPR). We justify our overriding legitimate interest in particular as follows: By participating in the Fritz Berger advantage card bonus programme, you have expressed your interest in receiving personalised information about Fritz Berger products and services. Where consent is required by law, for example for certain e-mail advertising or for certain categories of cookies, we obtain this consent. The basis is Art. 6 para. 1 sentence 1 lit. a) GDPR. If consent is not given, we will not carry out the data processing processes that require consent. Otherwise, legal permission standards, such as retention periods under tax law or the assertion, exercise and defence of legal claims, permit the processing of your data.
4. Recipients or categories of recipients of your data
4.1 Fritz Berger:
Fritz Berger, as the responsible body, only has access to your data to the extent necessary to achieve the purposes in accordance with the internal allocation of tasks. For this purpose, only those departments and employees who actually need access to your data are granted access internally.
4.2 Service providers:
We have engaged service providers who have access to your data as processors and process it exclusively for purposes specifically defined by us. These processors may be marketing service providers, website hosting service providers, IT support service providers or website analysis service providers.
4.3 Other third parties:
We may share your data with public authorities, external consultants or courts. If we have a Fritz Berger branch operated by a trading partner, we will pass on your data to these trading partners to the extent necessary.
5. Duration of storage of your data
In principle, we process and store your data for the duration of our contractual relationship. This also includes the initiation of a contract (pre-contractual legal relationship). In addition, we have to comply with various retention and documentation obligations for your data, including those arising from the German Commercial Code (HGB) and the German Fiscal Code (AO). The retention and documentation periods specified there are up to ten years beyond the end of the contractual relationship or the pre-contractual legal relationship. Furthermore, special statutory provisions may require a longer retention period, e.g. the preservation of evidence within the scope of statutory limitation provisions. According to Sections 195 et seq. of the German Civil Code (BGB), the regular limitation period is three years, but limitation periods of up to 30 years may also apply. If the data is no longer required for the fulfilment of contractual or legal obligations and rights, it is regularly deleted, unless its - temporary - further processing is necessary for the fulfilment of the purposes listed above for an overriding legitimate interest.
6. Your data protection rights
You can assert the following data protection rights against us:
- Right to withdraw consent given :
If you have given your consent with regard to certain types of processing activities, you can withdraw this consent at any time with effect for the future. However, this revocation does not affect the legality of the processing prior to the revocation of your consent or insofar as the processing can be justified on another legal basis.
- Right to information :
You have the right to receive information from us about your data stored by us (Art. 15 GDPR), if necessary with restrictions according to § 34 BDSG.
- Right to rectification :
At your request, we will correct the data stored about you in accordance with Art. 16 GDPR if it is inaccurate or incorrect.
- Right to erasure :
If you wish, we will erase your data in accordance with the principles of Art. 17 GDPR, provided that this does not conflict with other statutory regulations (e.g. statutory retention obligations or the restrictions under Section 35 BDSG) or an overriding interest on our part (e.g. for the defence of our rights and claims).
- Right to restriction of processing :
Taking into account the requirements of Art. 18 GDPR, you can demand that we restrict the processing of your data.
- Right to object :
Existence of a right to object in special situations You have the right to object, on grounds relating to your particular situation, to the processing of your data which is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in us (Art. 6 para. 1 sentence 1 lit. e). This also applies to profiling based on the above provision. If you object to the processing, we will no longer process your data for these purposes unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.
- Existence of a right to object to the processing of data for advertising purposes, including related upstream processing (profiling) .
We process your data for advertising purposes and carry out processing in advance in order to align our marketing measures with your interests (profiling). This processing for the purpose of direct advertising is carried out on the basis of an overriding legitimate interest. You can object to the processing of your personal data for the purpose of direct marketing at any time. This also applies to profiling insofar as it is associated with direct marketing. If you object to processing for direct marketing purposes, your data will no longer be processed for these purposes. Your objection can be made without adhering to a special form. You also have the right to lodge a complaint with any competent data protection supervisory authority (Art. 77 GDPR). 7. Scope of your obligations to provide us with your data
There is no legal obligation to provide your data to Fritz Berger. However, you cannot participate in the Fritz Berger advantage card bonus programme if you do not provide us with your data. The provision of your data is completely voluntary. If you do not provide your data, you will not suffer any legal disadvantages, but you will not be able to enjoy the benefits and services of the Fritz Berger Vorteilskarte bonus programme.
8. Are automated decision-making processes used?
You have the right not to be subject to a decision based solely on automated processing - including profiling - which produces legal effects concerning you or similarly significantly affects you (Art. 22 GDPR). We generally do not use such automated decisions. Should we exceptionally carry out such processing, we will inform you of this in advance.
9. Creation of profiles (profiling)
We process your data partly automatically with the aim of informing you about the services and products of Fritz Berger GmbH in a way that is as relevant to your interests as possible. In doing so, we take into account an existing business relationship, including the services and products previously utilised by the customer and the scope of sales.
